1. Service
PULSO ("the Service") is an employee-engagement platform that lets organizations deploy AI-powered check-in conversations and surface aggregated sentiment analytics. By creating an account, you ("Customer") agree to these Terms. The party operating the Service is PULSO, Inc. ("PULSO", "we", "us").
2. Accounts and authority
You represent that you are authorized to bind your organization to these Terms. You're responsible for keeping your login credentials confidential and for all activity under your account, including activity by team members you invite. Notify us immediately at security@pulso.ai if you suspect unauthorized access.
3. Subscription and billing
Paid tiers are billed in advance via Stripe on a monthly or annual cycle. Plans renew automatically until canceled. Cancellation takes effect at the end of the then-current billing cycle; we do not pro-rate refunds. If a payment fails, the account moves to past_due until the outstanding balance is settled. Pricing changes affect new subscriptions immediately and existing subscriptions at the start of the next billing cycle.
4. Acceptable use
- Use the Service only with employees who have been informed that participation is voluntary and that responses are shared with leadership in aggregate.
- Don't attempt to circumvent rate limits, RLS policies, slug enumeration protections, or our authentication system.
- Don't use the platform to surveil, retaliate against, or discriminate against employees.
- Don't use the AI conversation engine for purposes other than employee check-ins (e.g., customer support, market research, generic chatbots).
5. Data processing
When you upload, post, or generate data through the Service, you grant PULSO a non-exclusive, worldwide license to host, process, and analyze that data solely to provide the Service. You retain ownership. Our data-handling commitments are described in the Privacy Policy.
6. AI outputs
Engagement scores, themes, and recommended actions are produced by an AI model and are intended as starting points for human judgment. Don't rely on them as the sole basis for hiring, firing, compensation, performance, or disciplinary decisions. Use them to generate hypotheses and prompt conversations, not to substitute for them.
7. Service availability
We aim for 99.9% monthly uptime measured outside of announced maintenance windows. If we miss this target on a paid tier, eligible customers may request service credits proportional to the downtime in writing within 30 days. Credits are our sole remedy for downtime.
8. Intellectual property
PULSO's name, logos, dashboards, prompts, scoring rubric, and codebase are owned by PULSO. Customer Data is owned by the Customer. Each party retains all rights not expressly granted in these Terms.
9. Confidentiality
Each party agrees to protect the other's non-public information with the same degree of care it uses for its own confidential information (and no less than reasonable care). These obligations survive termination for three (3) years.
10. Termination
You may cancel your subscription at any time from the billing portal. We may suspend or terminate the Service if you breach these Terms or use the platform in a way that creates legal or operational risk. Upon termination, you may export your data for thirty (30) days, after which we permanently delete it.
11. Warranty disclaimer
The Service is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, PULSO's aggregate liability under these Terms is capped at the fees paid to us by the Customer in the twelve (12) months preceding the event giving rise to liability. We are not liable for indirect, consequential, special, or punitive damages.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes are exclusively subject to the courts located in Wilmington, Delaware.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced at least 30 days in advance via email to the workspace owner. Continued use after the effective date constitutes acceptance.
